Contractual Agreement
2023 - 2024 School Year
THIS CONTRACTUAL AGREEMENT made and entered into on June 17, 2023, by and between Dr.
Elise Moore, party of the first part, hereinafter referred to as “Contractor” and Marion County Board of
Education, Mary Lou Retton Drive, Fairmont, West Virginia 26554, party of the second part, hereinafter
referred to as “County”.
WHEREAS, the Contractor hereby agrees to provide functional vocational assessments.
PERIOD OF TERM: Beginning July 1, 2024, through June 30, 2025, according to the County’s school
calendar.
COMPENSATION: County will pay the Contractor $100 per evaluation report and $50 per IEP
Meeting. Payment will be made upon receipt of an itemized billing statement documenting the date, students
served, and service provided. These statements shall be delivered to the Marion County Board of Education
Pupil Services Department on a monthly basis.
GENERAL CONDITIONS:
1. The contractor agrees to perform all of the required services as aforementioned in an efficient and
appropriate manner.
2. The County will provide the contractor with a list of students for evaluation.
3. The contractor will work in contact with and report all activities to the Marion County Board of Education
Supervisor of Pupil Services.
4. The contractor will work in contact with and report all activities to the Board of Education Supervisor of
Pupil Services. Test instruments and protocol sheets will be provided by the Marion County Board of
Education. Unless otherwise indicated, contractor will supply a typewritten report on each student
evaluation within a twenty (20) day period of time following the evaluation as stated within the current
West Virginia Regulations for the Education of Exceptional Students. Test protocols are to be
forwarded to the Marion County Board of Education Pupil Services Department with the evaluation
report. Reports shall give descriptions of student's present level of educational performance and
educational needs but will in no way contain statements of final eligibility category or placement.
Reports must be signed and dated.
5. Services will be paid upon submission of a monthly invoice.
6. The contractor agrees to abide by the West Virginia Regulations for the Education of Exceptional
Students and the Federal Individuals with Disabilities Education Act, and any revisions or modifications
thereto.
7. The contractor will be responsible for maintaining appropriate confidentiality for all information.
Breaches of confidentiality will be grounds for the immediate termination of this contract.

8. The Contractor, in executing this contract, agrees, unconditionally, and expressly hereby waives any
right to Workers Compensation benefits, Federal and State tax withholdings, FICA withholding/benefits,
Unemployment Compensation benefits, any and all liability insurance coverage(s), retirement
withholding benefits, seniority rights, and/or any other rights and privileges afforded regular employees
of the County.
9. In County Travel will be reimbursed between schools at the current mileage reimbursement rate (to be
submitted to the Pupil Services Department monthly).
THIS AGREEMENT constitutes the entire contract between the Contractor and the County with respect to
services covered by this agreement and no representation or statements not expressed herein shall be
binding. The terms and conditions herein shall prevail notwithstanding any variance.

Interpreter/Consulting Services Contract
This Contract for Interpreting Services/ substitute is made and entered into on 17" day of June
2024, by and between Marion County Schools of 1516 Mary Lou Retton Drive Fairmont, WV
26554 and Sign Works Services of PO Box 4517, Bridgeport, WV 26330.
The last day of Interpreting services will conclude on June 30%, 2025.
Now, Therefore, for and in consideration of the mutual promises and agreements contained
herein, Marion County Schools hires Sign Works Services and Sign Works Services agrees to
work for Marion County Schools under the terms and conditions hereby agreed upon by both
parties.
Job Summary: The Sign Language Interpreter provides interpreting and other support services
for pupils who are deaf or hard of hearing in all areas of the education environment. The
interpreter’s primary function is to facilitate communication among deaf or hard of hearing
students and their hearing peers, the classroom teacher, and other personnel in the school system.
Follows the Registry of Interpreters (RID) Code of Conduct.
Identify and resolve conflicts related to the meaning of words and concepts.
Participates as a member of the Individualized Education Plan (IEP) team at meetings
and conferences. Provides insight and recommendations regarding communication in the
development and review of progress on the IEP, including evaluations of student use of
an interpreter.
Will provide substitute interpreters when needed and when available.
Prepares for daily lessons/school-related activities and preview media for interpreting.
This job summary in no way states or implies that these are the only duties to be
performed by the Interpreter. The Interpreter may be required to follow other job-related
instructions and to perform other job-related duties as requested. Consulting services

Compensation: In consideration of all professional Interpreting/consulting services to be
rendered by Sign Works Services (SWS) to Marion County Schools, Marion County

Schools shall pay to Sign Works Services the following rates.
Compensation shall be paid on the following basis:
Substitute Interpreting Services: Services provided up to five (5) consecutive days at the rate of
$60.00 per hour
Long Term Substitute Services: Services provided for a long-term assignment, in the same
setting, after five (5) consecutive days at the rate of $49.00 per hour
Interpreter/consultant services not to exceed 80 hours per month.
Contract PO not to exceed $21,600.00
Invoices will be generated twice monthly and shall be paid upon receipt.
Interpreters will be under the direction of the classroom teacher. If these schedules need to be
modified, Sign Works Services will be flexible in the modification of the student’s schedule.
If the appointing authority (Marion County Schools) cancels the Interpreter on the day of the
assignment, then the appointing authority will pay the Interpreter one hundred percent (100%) of
the anticipated total daily hours. Interpreter may be utilized in another capacity in the county
and/or use as classroom/prep time with classroom teacher.
e Example: Student does not show up for school or is not coming in till the
afternoon or leaves early.
e Ifthe interpreter is notified by 6:00 pm the evening before of an absence or of
a cancellation and/or delay due to inclement weather, there will be no billable
hours.
¢ Minimum of two (2) hours for interpreting services: meetings, IEP, consulting
Independent Contractor Status:
Withholding: Sign Works Services shall be responsible for their own income taxes and other
employment taxes. Sign Works Services will also maintain Liability Insurance for all its
Interpreters and keep all Interpreters credentials and/or certifications current.
Sign Works Services Acknowledges that they are an independent contractor and is not an agent,
partner, joint venturer nor employee of Marion County Schools.
Sign Works Services shall provide, while providing said Interpreting services, that Sign Works
Services shall comply with the policies, standards, and regulations of Marion County Schools,
including local, State and Federal laws to the best of their abilities.

Contract Renewal: This contract shall terminate on June 30, 2024. Automatic renewal of this
contract is prohibited. Renewal of this contract for successive school years may be negotiated
and approved by Marion County Schools and Sign Works Services.

following the evaluation as stated within the current West Virginia Regulations for the

an invoice to the Supervisor of Pupil Services.
6. Music Therapist agrees to abide by the West Virginia Regulations for the Education of
Exceptional Students and the federal Individuals with Disabilities Education Act, and any
revisions or modifications thereto.
7. Music Therapist will be responsible for maintaining appropriate confidentiality for all
information. Breaches of confidentiality will be grounds for the immediate termination of this
contract.
8. This contract shall terminate, by its terms, on June 30, 2025. This contract may also be
terminated by either party upon thirty (30) days written notice. Further, the Board of
Education reserves the right to immediately terminate this contract if Music Therapist
breaches confidentiality; fails to timely evaluate students; fails to timely supply evaluation
reports; fails to submit daily logs or schedule; or fails to attend meetings when requested to
do so,

2. The Marion County Board of Education will compensate psychologist at the rate

a. $350.00 per evaluation (including both cognitive and achievement
assessments)
b. $50.00 per supplemental data (including adaptive ratings and all other
rating scales)

. $150 per achievement (only) evaluation
$250.00 per ADOS-2/Autism Evaluation (standalone evaluation)

3. Psychologist will assess assigned students using appropriate individually
administered intelligence and achievement evaluations, set forth in the current
West Virginia Regulations for the Education of Exceptional Students. Evaluation
components shall, at a minimum, include (unless otherwise indicated): a
comprehensive ability assessment and a comprehensive achievement
assessment. Psychologist will report results in terms of standard scores and/or
scaled scores as dictated by the assessment instrument/method.

4. The psychologist will use additional evaluation components as deemed
necessary in his/her professional opinion to fully assess the present levels of
educational performance and educational needs of the student. The
psychologist will collaborate with the programmatic liaison to arrange evaluation
dates and sites.
. The psychologist will review the SAT, and any other information provided, to
determine the reason for referral so that he/she will know which assessment to
use. The psychologist must verify that parental consent for evaluation has been
obtained.
. Psychologist agrees to attend, upon request, educational meetings with respect
to the students tested, including, but not limited to, eligibility meetings,
manifestation determination meetings and IEP meetings. Consultation and
attendance at these meetings will be compensated at the rate of $50.00 per hour.
. The Board agrees to provide the Psychologist with the appropriate materials
needed to complete the contracted services.
. Psychologist will work in contact with and report all activities to the Board of
Education Supervisor of Pupil Services. Test instruments and protocol sheets
will be provided by the Marion County Board of Education. Unless otherwise
indicated, psychologist will supply a typewritten report on each student evaluation
within a twenty (20) day period of time following the evaluation as stated within
the current West Virginia Regulations for the Education of Exceptional Students.

consideration to the Safe Schools Act/FAPE make a placement recommendation
via written report for a fee of $300.00. This report shail be provided to the Board
of Education Supervisor of Pupil Services within 48 hours of evaluating the
student.

student.

(hereinafter “The Board of Education”), desires to contract for psychological testing
services and consultation; and
WHEREAS, Kristen Thompson, (Hereinafter “Psychologist") desires to provide this
assistance to the Marion County Board of Education;
NOW, therefore, it is hereinafter agreed as follows:
1. Psychologist will provide psycho-educational evaluations of students, re-
evaluations of students, and consultation regarding those evaluations to the
Marion County Board of Education. Commencement of these activities may
begin upon verification from the West Virginia Department of Education on the
certification/licensure of the above name individual.
2. The Marion County Board of Education will compensate psychologist at the rate
of:
a. $350.00 per evaluation {including both cognitive and achievement
assessments)
$50.00 per supplemental data (including adaptive ratings and all other
rating scales)
$200.00 per cognitive (only) evaluation
$150 per achievement (only) evaluation
$250.00 per ADOS-2/Autism Evaluation (standalone evaluation)

3. Psychologist will assess assigned students using appropriate individually
administered intelligence and achievement evaluations, set forth in the current
West Virginia Regulations for the Education of Exceptional Students. Evaluation
components shall, at a minimum, include (unless otherwise indicated): a

assessment. Psychologist will report results in terms of standard scores and/or

to the students tested, including, but not limited to, eligibility meetings,
manifestation determination meetings and IEP meetings. Consultation and
attendance at these meetings will be compensated at the rate of $50.00 per hour.
. The Board agrees to provide the Psychologist with the appropriate materials
needed to complete the contracted services.
. Psychologist will work in contact with and report all activities to the Board of
Education Supervisor of Pupil Services. Test instruments and protoco! sheets
will be provided by the Marion County Board of Education. Unless otherwise
indicated, psychologist will supply a typewritten report on each student evaluation
within a twenty (20) day period of time following the evaluation as stated within
the current West Virginia Regulations for the Education of Exceptional Students.
Test protocols are to be forwarded to the Marion County Board of Education
Pupil Service Department with the evaluation report. Reports must be signed
and dated.
. Services will be paid from county funds upon submission of a monthly invoice.
Reimbursement for mileage from the Board of Education/Central Office to a
designated school will be provided to the Psychologist at the current federal rate
(mileage form and billable miles will be provided).
10. When a student is referred for a social/emotional status evaluation, the

psychologist will review, within twenty-four (24) hours, the incident report and/or
manifestation determination report forwarded from the Board of Education. The
psychologist will complete the appropriate evaluations and after giving careful
consideration to the Safe Schools Act/FAPE make a placement recommendation
via written report for a fee of $300.00. This report shall be provided to the Board
of Education Supervisor of Pupil Services within 48 hours of evaluating the
student.

Terms of Service
This agreement made and entered into on the 17th day of June, 2024 by and between Christine Holsopple,
party of the first part, hereinafter referred to as “Service Provider’ and Marion County Board of Education, 1516
Mary Lou Retton Drive, Fairmont, WV 26554, party of the second part, hereinafter referred to as “County.”
WHEREAS, the Service Provider hereby agrees to provide consultative services to the pupil services department
in the areas of IEP training sessions, professional development on IEP writing and compliance, WVEIS 2.0 IEP
platform for report retrieval and WVDE submissions, consultation with liaisons regarding IEP compliance, training
on electronic filing systems, and DLM training.
PERIOD OF TERM: Beginning July 1, 2024, through June 30, 2025
CALCULATION OF FEES/COMPENSATION: Payment will be made upon receipt of an itemized billing
statement documenting the date, project task, consultative meeting and/or professional development provided.
These statements shall be delivered to the Marion County Board of Education Department of Pupil Services on
a monthly basis. Fees for professional services are calculated on the time spent by the Service Provider
multiplied by the relevant hourly rate. The hourly rate is applied to all work done on the Boards behalf. The
hourly rate for Service Provider's professional service is $50.00. The contract shall not exceed the contract total
of 200 hours. The Service Provider will be compensated for travel from the central office to any schools aligned
with the LEAs compensation for travel. Services will be paid monthly from IDEA funds upon submission of
invoice.
SERVICES PROVIDED:
1. Perform all of the required services as aforementioned in an efficient and appropriate manner.
2. The Service Provider agrees to provide services and documentation aligned with those predetermined
tasks by the Supervisor of Pupil Services.
3. The Service Provider will submit a monthly mileage report from the Central Office to designated
schools. In county travel expenses will be aligned with the current rate.
4. The Service Provider will work in contact with and report all activities to the Marion County Board of
Education Supervisor of Pupil Services.

5. The Service Provider will maintain communication with the county via email and face to face meetings
to ensure accurate timelines for projects and services.
6. The Service Provider agrees to abide by the West Virginia Regulations for the Education of Exceptional

7. The Service Provider will be responsible for maintaining appropriate confidentiality for all information.

8. THIS AGREEMENT constitutes the entire contract between the service provider and the County with
respect to services covered by the agreement and no representation or statements not expressed
herein shall be binding. The terms and conditions herein shall prevail notwithstanding any variance.

Terms of Service
This agreement made and entered into on the 17th day of June, 2024 by and between Rosa Anna Gallucci,
party of the first part, hereinafter referred to as “Service Provider” and Marion County Board of Education, 1516
Mary Lou Retton Drive, Fairmont, WV 26554, party of the second part, hereinafter referred to as “County.”
WHEREAS, the Service Provider hereby agrees to provide training for functional vocational assessments.
PERIOD OF TERM: Beginning July 1, 2024, through June 30, 2025
CALCULATION OF FEES/COMPENSATION: Payment will be made upon receipt of an itemized billing
statement documenting the date and project task. These statements shall be delivered to the Marion County
Board of Education Department of Pupil Services on a monthly basis. Fees for professional services are
calculated on the time spent by the Service Provider multiplied by the relevant hourly rate. The hourly rate is
applied to all work done on the Boards behalf. The hourly rate for Service Provider's professional service is
$50.00. The contract shall not exceed the contract totai of 20 hours. The Service Provider will be compensated
for travel from the centrai office to any schools aligned with the LEAs compensation for travel. Services will be
paid monthly from IDEA funds upon submission of invoice.
SERVICES PROVIDED:
1. Perform all of the required services as aforementioned in an efficient and appropriate manner.
2. The Service Provider agrees to provide services and documentation aligned with those predetermined
tasks by the Supervisor of Pupil Services.
3. The Service Provider will submit a monthly mileage report from the Central Office to designated
schools. In county travel expenses will be aligned with the current rate.
4. The Service Provider will work in contact with and report all activities to the Marion County Board of
Education Supervisor of Pupil Services.
5. The Service Provider will maintain communication with the county via email and face to face meetings
to ensure accurate timelines for projects and services.

6. The Service Provider agrees to abide by the West Virginia Regulations for the Education of Exceptional
Students and the Federal Individuals with Disabilities Education Act, and any revisions or modifications
thereto.
7. The Service Provider will be responsible for maintaining appropriate confidentiality for all information.
Breaches of confidentiality will be grounds for the immediate termination of the contract.
8. THIS AGREEMENT constitutes the entire contract between the service provider and the County with
respect to services covered by the agreement and no representation or statements not expressed
herein shall be binding. The terms and conditions herein shall prevail notwithstanding any variance.
