MEMO OF UNDERSTANDING — Horizons Grant — Kalama School District No. 402 5. Responsibilities of the Partner. The Partner shall: a. Partners agree to uphold the submitted strategy of the grant and participate actively in the regional partnership's success. b. Assign an Executive point of contact to serve on and regularly attend the Steering Committee. c. Designate a building-level liaison who will support the CCRA in successfully implementing their scope of work. d. Partners agree that the scope of work is determined by ESD112 as described in the Gates Horizons Implementation Plan, and that the CCRA position will not be assigned to projects outside the scope of the Implementation Plan without written approval from the ESD112 Postsecondary Readiness Manager. e. Provide reliable space for the CCRA to work at the school site, regular access to the building and other areas to support students, necessary technology (such as Wifi, access to Google classroom if needed, etc.) f. Collaborate on and implementing a schedule for the CCRA, including designated times for the CCRA to work with Year 11 and 12 students throughout the school year g. Enter into a data sharing agreement with ESD112 (See Appendix A) as the backbone of the partnership. Engage in learning and evaluation activities, including sharing requested data with the statewide and local third-party learning and evaluation (MLE) partner. h. Use data produced from the partnership to inform strategic decision making and program implementation as they relate to high school to postsecondary enrollment. i. Ensure the Partnership meets its stated deliverables and timeline during the 2024-25 implementation year (See Appendix B). 6. Non-Discrimination. Per requirements of state, local and federal laws, ESD112 and the Partner agree not to discriminate on the basis of race, color, creed, religion, national origin, age, sex, gender expression or identity, sexual orientation, genetic information, honorably discharged veteran or military status, marital status, family/parental status, income derived from a public assistance program, political beliefs, non-job-related physical, sensory, or mental disabilities, use of a trained guide dog or service animal or reprisal or retaliation for prior civil rights activity. Inquiries regarding compliance and/or grievance procedures for ESD112 may be directed to ESD112 at its address above. 7. Notice. Notice of termination or amendment to responsibilities under this MOU shall be provided by emailing, with receipt confirmation, or mailing notice to the signature authority in Section 8 below. Notice shall be deemed effective upon the earlier of actual receipt or three (3) days after notice is deposited in the United States Postal Service mail, by certified mail, postage prepaid. 8. In this agreement, Kalama School District No. 402 will be referred to as (Partner) and Educational Service District 112 will be referred to as ESD 112. |. PURPOSE OF WORK This agreement sets out the terms and conditions under which Partner will provide ESD 112 access to collect non-identifiable and confidential student demographic data for the Washington Jobs Initiative, administered by Washington Student Achievement Council, the Horizons Postsecondary Readiness Investment, funded by the Gates Foundation, and the SW WA Rural CTE Cooperative, administered by ESD112. Receiving this data from Partner students and staff will allow ESD 112 to analyze course participation from the Partner student body and staff and report these outcomes to Computing For All, the project lead for this Washington Jobs Initiative grant. This partnership between Partner and ESD 112 will also make it possible for ESD 112 and Partner to understand the gaps and trends of CTE course enrollment and completion of Partner. Il. DUTIES OF PARTIES Exhibit A outlines the duties to be performed by each party. ESD 112 will share the summative data to Partner and by the 30" of June, annually. Ill. CONFIDENTIAL INFORMATION All student and staff survey data provided by Partner to ESD 112 is confidential information. IV. REDISCLOSURE OF INFORMATION ESD 112 may be legally compelled to disclose any confidential information (whether by judicial or administrative order, applicable law, rule, or regulation, or otherwise), it must use all reasonable efforts to provide Partner with prior notice before disclosure so that ESD 112 may seek an appropriate remedy to prevent the disclosure or to ensure compliance with the confidentiality requirements of federal or state law. If a remedy is not obtained prior to the Page 3 of 7 MEMO OF UNDERSTANDING — Horizons Grant — Kalama School District No. 402 deadline by which any legally compelled disclosure is required, ESD 112 will disclose only that portion of the confidential information that it is compelled to disclose under law. V. LIMITATION ON ACCESS AND USE ESD 112 agrees to the following limitations on the use of the confidential information provided by Partner: a. ESD 112 shall not use the information provided for any purpose not specifically authorized under this agreement without prior approval from Partner. b. ESD 112 will share only aggregate analysis of the data provided by Partner students and staff in combination with other high schools to the funders of this project; ESD 112 will not share any information outside of that with any other parties without prior approval from Partner. c. ESD 112 shall protect the confidentiality of the information as required by the terms of this agreement and the laws cited in this agreement. d. Data provided by students and staff may be retained by ESD 112 over time to simplify its work or perform any Partner-requested longitudinal analyses. e. Except as provided in subsection d, ESD 112 shall destroy all the information once access to that information is no longer needed to carry out the required work or upon termination of this agreement. VI. PHYSICAL SAFEGUARDS ESD 112 agrees to the following minimum safeguards for the information provided by Partner: Page 4o0f7 a. Access to the information provided by Partner will be restricted to only those authorized personnel who need it to perform their official duties described in this agreement. B. The information will be stored in an area safe from access by unauthorized persons during duty hours and non-duty hours or when not in use. c. The information shall not be stored on portable devices or media unless ESD 112 encrypts the device with commercial encryption software using a minimum of 128-bit encryption. d. The information will be protected in a way that prevents unauthorized persons from retrieving it by computer, remote terminal or other means. e. ESD 112 shall take the necessary precautions to ensure that only authorized personnel are given access to online files if applicable. MEMO OF UNDERSTANDING — Horizons Grant — Kalama School District No. 402 f. ESD 112 shall inform all personnel with access to the information regarding the confidential nature of the information, as well as the requirements of the LIMITATION ON ACCESS AND USE and PHYSICAL SAFEGUARDS clauses of this agreement. Vil. DATA DESTRUCTION ESD 112 agrees to destroy any confidential information within forty-five (45) days upon Partner’s request or upon termination of this agreement (unless there is a data sharing agreement extension), whichever occurs first. Both parties must sign a certificate of data destruction after the data is destroyed. VIII. TERMINATION OF ACCESS Partner may, at its discretion, disqualify an individual authorized by ESD 112 from gaining access to the information provided. Notice of termination of access will be by written notice and become effective upon receipt by ESD 112. Termination of access of one individual by Partner does not affect other individuals authorized under this agreement.
