Interlocal Agreement between the Mount Vernon School District (MVSD) on behalf of the
Northwest Career & Technical Academy (NCTA) and Meridian School District (MSD):

NCTA Open Doors Program 2024-2025 School Year

Interlocal Cooperative Agreement
This Educational Cooperative Agreement ("Agreement") is entered into by and between Mount

Vernon School District, herein referred to as MVSD, as the Host District of the Northwest Career
& Technical Academy, herein referred to as NCTA, and Meridian School District herein referred
to as MSD, both political subdivisions of the State of Washington.

Purpose
The purpose of this Agreement is to provide a specific NCTA satellite program, NCTA Open

Doors at Whatcom, at a Meridian School District location provided both parties mutually agree
that there is an adequate need to offer the Program. This satellite NCTA Open Doors Whatcom
Program will serve as the diploma option through the Mount Vernon School District's well-
established NCTA Open Doors program running in conjunction with the NCTA Skills Center.

Terms

This Agreement shall commence on September 1, 2024, and continue through the end of the
regular NCTA 2024-2025 school year, inclusive of summer session and unless terminated
earlier as provided for in the Agreement. This Agreement may be renewed for successive one-
year periods upon mutual written agreement by the parties.

MSD Rights and Responsibilities
1. Access: MSD shall provide a right of access to NCTA documentation, as it pertains to

this Agreement for the purpose of auditing, monitoring and/or evaluating performance
and compliance with this Agreement.

2. Equipment and Supplies:MSD shall provide the necessary space to store teacher
materials, classroom materials and storage for equipment and supplies for the program.
MSD will provide keys, computer access, phone access, printer and copier access and
the like for the instructor.

3. Student Discipline: MSD authorized staff will have the authority to temporarily remove a
student from the daily instruction of the program until NCTA administration can be
brought into the situation and a determination in response to discipline is made.

Educational Services

MSD shall provide a secondary certified instructor in accordance with WAC 181-77-031 and
WAC 181-77-041 to deliver an equivalency-based instructional model and student supervision
services at a specified location. The instructor shall solely be an employee of MSD and not an
employee of MVSD.


Instruction Program Specifics

An MSD-certified instructor shall provide instruction in a half-day, 150-minute daily instructional
blocks per year. The instructor shall utilize an approved NCTA curriculum and follow all NCTA
policies and procedures during the program to the extent they do not conflict with the policies
and procedures of MSD. Evaluation of the MSD-certified instructor is the responsibility of the
MSD administration.

Record Keeping and Accounting

MSD shall provide adequate record-keeping and reporting, as required by federal, state and
local laws. This includes maintaining books, records, documents, and other evidence that
sufficiently and properly reflect all direct costs expended in the performance of the services
contemplated by this Agreement.

NCTA Rights and Responsibilities

1. Support Services: NCTA shall process all NCTA student enrollment in the Program
through the normal Open Doors/Youth Reengagement procedures. NCTA shall provide
coordination of enrollment and required OSPI reports for the Program through the
enrollment and apportionment process.

2. Student Support: NCTA will coordinate the support for students accessing IEPs and 504.
MVSD will become responsible for the acceptance, writing and administration of IEPs.

3. Professional Development: NCTA will serve as the primary provider of professional
development specific to the NCTA Open Doors program and model of instruction.

4. Student Rosters: NCTA will maintain student rosters to be shared with appropriate MSD
staff including family and school contacts, phone numbers and any relevant emergency
information. NCTA will provide a monthly memo to the superintendent and business
office directly off the P223 reporting.

Monetary Payment

NCTA shall flow through 85% of the claimed apportionment to MSD. Other costs for
reimbursement may be mutually agreed upon by both entities. MSD will periodically invoice
NCTA based on the P223 reporting for MVSD NCTA Open Doors (School Code CTW).

Monitoring

NCTA will monitor the program which will include reviewing reports, performing site visits to
review programmatic records and observe operations, reviewing audit results, evaluating audit
findings and any corrective action plan, and any other procedures deemed necessary.

Rights and Responsibilities of All Parties
1. Compliance with Rules and Laws: The parties shall comply with all laws, ordinances and
regulations of governmental bodies applicable to the Program as well as applicable local
policies and procedures.
2. Record Checks: Any applicant or employee of the parties who will have regularly
scheduled unsupervised access to children pursuant to this Agreement shall be required


to complete a record check through the Washington State Patrol Criminal Identification
System and the Federal Bureau of Investigation.

Nondiscrimination/Anti-Harassment
In the performance of this Agreement, the parties assure compliance with the Mount Vernon
School District non-discrimination policy.

Indemnification/Hold Harmless/Duty to Defend
Each party to this Agreement is responsible for the acts and omissions of its own officers,

employees, agents, and volunteers. Each party agrees to defend, indemnify, and hold any other
party harmless from and against any claim, demand, suit, or cause of action that may be
asserted against the Indemnitee.

Termination

Termination of this contract shall be at the end of the school year, which may include the end of

the NCTA summer session. If the facilities are no longer available, MSD will provide an
alternative location for the Open Doors Program.

This Agreement will be effective during the 2024-2025 school year, which may include the
NCTA summer session.
