Agreement This Agreement, made and entered into this 2nd day of May 2024, by and between the Jackson County Board of Education, West Virginia, hereinafter referred to as “BOARD” and the City of Ripley, West Virginia, hereinafter referred to as “CITY”. Witnesseth WHEREAS, the BOARD and the CITY understand the need to have an officer on duty on the premises of Ripley Middle School to assist with juvenile delinquency issues and respond to law enforcement events at the school; and WHEREAS, the BOARD and the CITY acknowledge the presence of a police officer is a great benefit to school administration, students and the community as a whole; WHEREAS, the BOARD wishes to contract with the CITY for a police officer to be stationed at Ripley Middle School; NOW, THEREFORE, in consideration of the mutual promises contained herein, the parties agree as follows: SECTION 1. DUTIES AND RESPONSIBILITIES OF THE CITY 1.01 The CITY shall provide an officer to be stationed at Ripley Middle School during the 2024-2025 school year on a schedule to be determined by the school principal. This schedule will reflect the days and hours to be worked by the officer and will be used to verify the invoices provided by the CITY to the BOARD. 1.02 The CITY shall be responsible for the control and direction of all aspects of employment of the police officer assigned to Ripley Middle School. 1.03 The CITY shall ensure that the exercise of the law enforcement powers by the officer is in compliance with the authority granted by law. 1.04 The CITY shall hold harmless the BOARD for any injuries suffered by the officer arising under their assignment to Ripley Middle School. 1.05 The officer shall not function as a school disciplinarian and it is not the responsibility of the officer to intervene with the normal disciplinary actions of the school system or be used as a witness to disciplinary procedures in the school. The officer will, at times, be expected to act within the scope of authority granted by the law. The officer will perform duties to the following: a. To perform law enforcement functions within the school setting. b. To identify and prevent delinquent behavior, including substance abuse. c. To foster a better understanding of the law enforcement function. d. To provide assistance and support for crime victims identified within the school setting. e. To promote positive relations between students and law enforcement officers. f. To be familiar with confidentiality requirements. SECTION 2. DUTIES AND RESONSIBILITIES OF BOARD 2.01 The principal, or designee, shall be the on-site contact person for the officer. 2.02 The principal, or designee, shall provide direction to the officer regarding assignments on the premises and provide information on law enforcement issues within the school. 2.03 Payments shall be processed upon submission of invoices by the CITY and certification by the principal or his/her designee that the services rendered were satisfactory. The monthly payments shall be based on a rate of $31.25 per hour, not to exceed a total of $18,281.25 and shall be made within 30 days of receipt of the invoice. SECTION 3. TERM OF AGREEMENT 3.01 This agreement shall be made for the 2024-2025 term beginning August 21, 2024 through June 30, 2025. SECTION 4. TERMINATION OF THE AGREEMENT 4.01 Either party may terminate this agreement by serving written notice upon the other party at least thirty (30) days in advance of such termination. SECTION 5. INDEMNIFICATION 5.01 The BOARD agrees to indemnify and save harmless the CITY for any liability whatsoever arising out of the negligent acts of the Board’s employees or agents in directing the officer in the performance of their duties. The CITY agrees to indemnify and save harmless the BOARD of any liability whatsoever arising to employment as defined by City Ordinances and West Virginia State Law. Nothing in this Agreement shall be construed to affect, in any way, the GRANTEE or the BOARD'S rights, privileges, or immunities. SECTION 6. COMPLETE AGREEMENT 6.01 This agreement is the complete Agreement of the parties, may be amended or modified only in writing, and supersedes, cancels, and terminates any and all prior agreements or understandings of the parties, whether written or oral, concerning the subject matter hereof.
