AGREEMENT OF AFFILIATION
BETWEEN
UNIVERSITY OF CHARLESTON NURSING DEPARTMENT
AND

Jackson County Schools

The articles of this Agreement are intended to define in general
the basis upon which Jackson County Schools will provide the
opportunity for clinical laboratory experiences for students
enrolled in the nursing programs at the University of Charleston.

These understandings are designed to set forth the basis of
cooperation and focus on the educational activities for nursing
students and the responsibilities of each of the parties involved
in this undertaking.

I.RESPONSIBILITIES OF Jackson County Schools
A. The agency will accept University nursing students for

clinical laboratory experience.

B. During the clinical laboratory experience the nursing staff:

1. may intervene in nursing students' experience when
student actions would create an unsafe or detrimental
situation.

2. should report any incident to the University nursing
instructor.

C. In the event of illness or injury during the clinical
laboratory experience, the agency will provide transportation
to the nearest emergency facility.

D. Jackson County Schools reserves the right to withhold from
the University the use of its facilities because of
failure on the part of the University students to meet the
standards of health or behavior required by its
administrative authority.

Jackson County Schools will provide the University with
written documentation of the reasons for such action.
II. RESPONSIBILITIES OF THE UNIVERSITY:

A. Organize and administer for its students the program of
study of nursing care needs of people in various

settings.

B. Assign to Jackson County Schools only those students who
qualify and have been predetermined to be suitable and
capable of this experience.

C. Provide Jackson County Schools with:

1. student learning objectives for the clinical
observation experience.

2. a schedule for the clinical experience prior to
the time of the students' arrival in the agency.

D. Upon request, the University will provide confirmation
that students and faculty members participating in this
program are covered by professional liability insurance
at limits of liability of no less than $1,000,000 per
occurrence and $3,000,000 aggregate per policy. Such
insurance shall be maintained throughout the agreement
term.

E. Require students to dress appropriately and to wear
appropriate identification.

EF. The University of Charleston agrees to require all
clinical students in the clinical area to have a
criminal background check rendered by a commercial
provider, to include screening to verify the following:

Name

Social Security Number

Global Terrorist Alert

Social Security Fraud and Abuse History

Criminal Records - US and counties of residence in
the last 7 years

Sexual Offender Alert —- .US and WV scan

Health Care Fraud and Abuse Scam history - US

Background checks will be completed prior to clinical
placement in the clinical agency. If and when student
violations are reported to the University by the
commercial background check provider, the UC Health
Sciences Division Chair will inform the clinical agency
about the violation or pattern of violations and the
agency will have opportunity to reject clinical
placement of the student (s)whose record reveals a
violation or pattern of violation or pattern of
violations unacceptable to the agency.

III. THE TWO PARTIES FURTHER AGREE JOINTLY:
A. Representatives from the two institutions may meet

prior to and following the clinical experience to:

1. discuss the observational experience from the
standpoint of the objectives of the agreement.

2. identify lines of communication between the two
institutions.
3. plan and/or evaluate the student learning
experience.
B. This agreement be in effect August 1st, 2024 through

August 1st, 2026.
IV. Title IX

The University of Charleton prohibits all forms for
discrimination on the basis of sex, gender, sexual orientation,
gender expression and gender identity in its educational programs
and activities. Prohibited conduct includes sex discrimination,
sexual harassment, sexual violence and retaliation.

In order for the University of Charleston to identify and
address Prohibited conduct, Jackson County Schools shall notify UC
of any reports it receives of Prohibited conduct related to a
student’s practicum at Jackson County Schools provided, however
that nothing herein requires communication that might result ina
waiver of any applicable privilege, including but not limited to
the peer review privilege and the attorney-client privilege. XXXXX
agrees to fully and faithfully cooperate with any inquiry,
investigation and/or adjudication conducted by University of
Charleston in response to a report of Prohibited conduct.

Similarly, the University of Charleston will notify Jackson
County Schools of any reports it receives of Prohibited conduct
related to a student’s practicum, provided, however that nothing
herein require communication that might result in a waiver of any
applicable privilege, including but not limited to the peer review
privilege and the attorney- client privilege. The University of
Charleston agrees to fully and faithfully cooperate with any
inquiry, investigation and/or adjudication conducted by Jackson
County Schools in response to a report of Prohibited conduct.

Each party shall promptly advise the other of any incident of
which it becomes aware that may represent a threat to the health
and safety of students.

Due to the nature of students being enrolled in semesters and the
requirement for the completion of clinical rotations, the
University of Charleston will be provided with 6 months’ notice of
any termination of this existing contract between parties.

Nothing contained herein shall be deemed to create or
acknowledge the existence of a joint venture between the
University and Jackson County Schools.

This agreement is entered into between the University and Jackson
County Schools solely for their individual benefit and as a means
of providing educational opportunities to students participating
in the nursing education programs at the University. No patient
or third party shall be deemed entitled to assert any rights
hereunder or to receive the benefits hereof.

It is recognized that the University's participation herein
is in order to enable it to provide an educational experience for
its students and the University shall be entitled to regulate the
activities of its students to the extent necessary to comply with
academic requirements. It is recognized that Jackson County
Schools has agreed to participate with the University in
providing an educational experience but that the primary
obligation of
Jackson County Schools is to its clients and in that regard, it
shall have the responsibility to the extent necessary to ensure
the well-being of clients and compliance of all laws, rules and
regulations governing its activities.

IN WITNESS THEREOF, the University of Charleston and Jackson
County Schools have caused this Agreement to be executed by the
respective authorized representatives contained below.
